Through careful analysis of much information regarding the activities of
NSEI, and the events within and surrounding that service, together with
information compiled on the individuals in HIP and NSEI director Ivan
Baketa, the thesis of the management structure of the most powerful secret
service in the country have proven to be true

      The National Center for Electronic Monitoring (NSEI) is under the
direct control of Miroslav Tudjman and his Association for the Identity and
Prosperity of Croatia (HIP). This information was confirmed to Nacional by
several sources close to the top ranks of the intelligence community in the
country. Those who did not confirm the information, did not even dare to
deny it. Even though Miroslav Tudjman is no longer formally a member of any
intelligence agency, he is controlling the most powerful one, which to a
great extent explains many of the scandals and mistakes which have occurred
within the intelligence community since the change of government on January
3, 2000.

   In recent weeks, there has been a constant shifting of responsibility,
from the Defense Ministry to the Presidential Office, from the Office for
National Security (UNS) to the Defense Ministry and so on. Not a single
state institution has admitted that NSEI is under its jurisdiction, even
though recently the details concerning the electronic monitoring system were
revealed to the public. This agency possesses the most modern technology for
wiretapping and monitoring, which can track ten thousand telephone calls,
faxes and e-mails at the same time, both within Croatia and outside the
country's borders.

    Instrumentation

      According to the claims by unofficial sources from several ministries,
as well as from the top ranks of the intelligence community, NSEI is under
the direct control of Miroslav Tudjman, who was formerly chief of the
Croatian Intelligence Agency (HIS) and is the eldest son of the late
president. In addition to Tudjman Jr., individuals gathered together in the
new non-political movement HIP also have great influence over the workings
of NSEI. HIP was established only a short time prior to the recent regional
elections by Tudjman Jr., while the leadership of the association consists
of characters such as Davorin Domazet Loso, the former admiral retired by
President Stipe Mesic after the famous "Generals' Letter" and Nenad
Ivankovic, former editor-in-chief of Vjesnik daily newspaper.
   Through careful analysis of much information regarding the activities of
NSEI, and the events within and surrounding that service, together with
information compiled on the individuals in HIP and NSEI director Ivan
Baketa, the thesis of the management structure of the most powerful secret
service in the country have proven to be true, claim Nacional's sources.
However, in order to completely understand how this instrumentalization
occurred, it is necessary to return to the first days of Croatia's
independence, to the time when the military was established and the state
created, together with the formation of the intelligence community, which
Miroslav Tudjman controlled as of 1993.
   "In order to understand what has occurred. one needs to know what HIS is
and how the intelligence community functions, or rather, how it has
functioned since its creation," was Miroslav Tudjman's statement in a recent
interview. He continued on to say, "In 1993, by a decree by the President of
the Republic, the Office for National Security was created, with the
Croatian Monitoring Service as the central agency. The task was to harmonize
and coordinate the reports which went towards the state administration,
which were prior to that coming to the president without verification or in
different time intervals. HIS, therefore, was established in order to
coordinate the functioning of the various agencies. The first task of HIS
was analysis: to deliver information to the state administration, the second
task was to coordinate the workings of the various agencies, the third was
cooperation with foreign agencies and the fourth was to compile intelligence
abroad." Miroslav Tudjman did not become the director of UNS (Office for
National Security), but rather was proposed to be deputy to the director.
Instead, he accepted the position of director of HIS, an agency which was
supposed to be under UNS, but with time was transformed into a separate body
which was not only coordinating, but also directing the workings of the
majority of the intelligence services, regardless of how many there were in
Croatia.
   Two years later, in June of 1995 Franjo Tudjman signed the decree for the
proclamation of the Law on the Office for National Security. In only 17
paragraphs, the tasks of UNS were outlined as were the details of its
internal structure, and that same law is still valid today because the new
government has not succeeded in working out the details of which agencies
are responsible for what, and thus nothing has been changed in the laws
which - stated conditionally - regulate that service. According the Law on
UNS, three agencies fall under its jurisdiction: HIS, the Observation Agency
and the Security Staff, while "for conducting other professional and
assistance tasks, the Decree on the Internal Organization of the Office
permits the establishment of other organizational units".

   Letter by Durda Adlesic

      As one of the former heads of the intelligence community commented, in
Croatia, everything deteriorates, and as such, these legal provisions also
deteriorated. Other than in the three agencies outlines in the decree, UNS
quickly received another two, which to this day are not regulated by any
legislative acts, rather only by the Acts on Internal Organization. These
two agencies are the Intelligence Academy of HIS and the infamous NSEI - the
National Center for Electronic Monitoring. Even though the Law on UNS did
not at all foresee the need to compile information, this is what NSEI does,
regardless of the fact that this activity cannot be categorized under any of
the four tasks outlined by the law. To recall, these four tasks are 1)
harmonizing the workings of the state ministries in conducting national
security affairs, 2) directing and supervising the work of the security
(both intelligence and counterintelligence) agencies, 3) compiling and
analyzing intelligence information and reports necessary for the carrying
out the constitutional tasks of the President of the Republic and the
government, and 4) caring for the counterintelligence protection and
security of the President of the Republic, the parliament and the government
and the facilities they occupy.
   However, certain points in the law on UNS were worked out in practice
this year because they were not precisely formulated. For example, employees
of the Office "with special duties and authority" have the same rights and
duties of authorized official individuals in the Police Ministry, while the
financial resources for the workings of the Office are secured from the
national budget. So even though UNS has special clauses within the law, NSEI
does not exist outlined anywhere in the budget. The resources for its
functioning are ensured among the other regulations in the Defense Ministry,
and active Minister Jozo Rados either does not know this or is intentionally
keeping this fact quiet in his public statements. This was the case recently
when he claimed that the Defense Ministry had no connections to NSEI.
However, after Nacional uncovered the story of NSEI, the president of the
parliamentary board for national security, Durda Adlesic, wrote Rados a
letter, asking to be fully informed of the connections between the ministry
and NSEI. At first, Rados denied ever having received such a letter from
her. Only one day after this meeting with the press and his denial, Adlesic
showed the remaining members of the parliamentary board a portion of the
letter that Rados had written her in response to the original letter. Just
who is Rados lying to - the press or Durda Adlesic, and is there any truth
in the claims the Rados and a portion of HSLS are using NSEI for their own
benefits? Even though it is still unclear as to exactly when NSEI was
established, it is known that it was after 1995, and its director Ivan
Baketa came to his post during the time that Miroslav Tudjman was head of
HIS. Baketa, a former officer in the Yugoslav National Army, left JNA in
1991 to join the Croatian military. From the first days of his service, he
befriended Miroslav Tudjman and Markica Rebic, long time head of the secret
service SZUP. According to information Nacional received from the top ranks
of the intelligence community, the long time friendship between Tudjman,
Rebic and Baketa was never shaken, not even in the toughest moments, not
even when Tudjman was suspended, having been fired by his own father.
   In the secret service war, which has been going on for years since their
establishment, at one time, Miroslav Tudjman was declared before his father
to be "working for the Americans", which angered the president so much that
he immediately removed him from his position, personally insulted due to his
own intolerance towards America. Shortly after, in just the same way that he
was fired, Miroslav was returned to his position with no explanations. The
accusations against Tudjman Jr., looking from today's perspective, were not
without reason. The connections between Tudjman Jr. and the Americans have
not been cut to this day, and several distinguished American experts in
national security even participated in the review he launched last year
dealing with the problems of national security. The second connection to the
Americans can be seen in NSEI. Even though the system uses German
technology, it is based on the American system Echelon. The intelligence
system Echelon was first brought to the light of day early last year by
author Duncan Campbell, whose text quickly aroused panic in Europe. In his
writings on Echelon, Campbell stated that this was an intelligence network
which compiled information from millions of telephones, fax machines and
e-mails, and that it was possible to use the system to monitor the largest
businesses in Europe.


  Intelligence Camouflage

      In addition to the US, Canada, Great Britain, Australia and New
Zealand are involved in the Echelon system, which was established long ago
in 1947 at the beginning of the Cold War. In the meantime, it grew into an
entire organization which included network stations for monitoring and
compiling information worldwide, and allegedly, even the United States
National Security Agency has been using its services. It was with the help
of the Echelon software that the conversation between Ivic Pasalic and
Robert Horvat concerning the Lepej affair was "accidentally intercepted".
This was just another one of Pasalic's setups used to warn or defame his
opponents, and in this case it was the President of the Republic who was
forced to cave into his blackmail.
   Otherwise, the story of the good relations between the Croatian
intelligence community and the Germans, and the interests that the Americans
have expressed in this region was already written about seven years ago, in
Jane's Intelligence Review. All of the information presented in that article
has turned out today to be amazingly correct. The conclusions of American
involvement in the Croatian intelligence community, with the mediation of
Miroslav Tudjman, is not just a creation by the media, but a fact, which
intelligence communities around the world treat very seriously.
   It is worthwhile mentioning that it was Pasalic's circle which launched
the defamation of Miroslav Tudjman as "working for the Americans".
Furthermore, up until very recently, Tudjman Jr. and Pasalic were not on
speaking terms, at least not in public. Their recent, and very coincidental
meeting at the Reporting Assembly of HDZ lead to a short conversation, the
first after years of reciprocal intolerance. Even the disappearance of the
documents from the Presidential Office, during the period of President
Tudjman's serious illness, did not make peace between the two men, even
though they both took documents to add to their private archives, leaving
behind nothing which could be compromising.


  Working for the Americans

       One of the main reasons why Miroslav Tudjman was greatly opposed to
any changes in the leadership of the intelligence agencies after the change
in government could be seen as his desire to continue controlling those
agencies. He succeeded on this front. Aside from the changes in a few of the
leadership positions within the agencies, the remaining staff all remained
in their positions, including in NSEI. The ruckus that Tudjman raised over
replacing the intelligence staff bore fruit - the new government decided
against it and pulled away from that initiative. And thus, there will be
long reaching consequences. A banal example was the success of HIP at the
recent regional elections. Miroslav Tudjman and his "independent list" knew
exactly which cities they could succeed in, and therefore only announced
their candidacy in those cities. It is difficult to believe that their
success there is coincidental. They had great success in Zagreb, and now
three of the city council members are from HIP. It was HIS that was
responsible in this project for "making political assessments".
   Another of the detrimental consequences was the so-called "intelligence
camouflage". According to a statement made by an intelligence agent, that
system had been used over the last few years. In order to cover up the
activities of one agency, a scandal involving another was released to the
public in order for the first agency to continue unhindered with its (legal
and illegal) activities. It was so in the "Dracevac case". That is, after
the scandal where those present booed the president during his visit to the
celebration at the Dracevac military base, SIS found itself a target of
revision by the parliamentary board for national security. Last week a
report concerning the matter was finally submitted, and neither SIS, nor the
military police, nor the Security Staff were satisfied with the contents of
the report. All three agencies share the blame for the incident in the
report, or rather, it was concluded that due to their errors, the scandal at
Dracevac was able to happen. Members of NSEI had reason to celebrate - at
exactly the moment that NSEI was revealed to the public, the report on the
Split SIS was completed, and spoke only of the mistakes made by the three
agencies mentioned above, with not a mention of NSEI. The public should,
according to NSEI, be satisfied with the report, and just forget about the
existence of NSEI. All this time, this agency has been in the sidelines, and
no one touched its functioning. Not one individuals has been replaced in
NSEI, even though it is well known that Miroslav Tudjman hand picked all of
the personnel within. It is obvious that the connection between HIP and NSEI
and in the intelligence community is the result of the ignorance of the
coalition government, which was only further fueled by failing to replace
anyone within that most powerful intelligence service.
